Tribal government gaming is the most highly regulated form of gaming in the United States. Regulation of tribal gaming operations occurs on three distinct levels. The first level of regulation comes directly from the tribal nations. The Indian Gaming Regulatory Act ("IGRA") states that tribes must establish a regulatory body, usually referred to as Tribal Gaming Agencies or Gaming Commissions, to keep operations in compliance with tribal gaming ordinances and Tribal-State compacts. As stated in the IGRA, these regulatory bodies are the primary regulators of tribal government gaming. In addition, tribes have developed tribal police forces, security and surveillance departments, and in some instances, court systems to combat crime. Indian nations engaged in governmental gaming have invested heavily in high-tech surveillance equipment and have more professionals regulating tribal casinos than any other gaming enterprise in other non-Indian jurisdictions.

The state of California acts in a secondary role in the regulation of Indian gaming. The Tribal-State compacts, negotiated between each individual tribal government and the state of California, provide the secondary role for regulating Class III gaming for the Department of Justice - Division of Gambling Control and the California Gambling Control Commission.
The third level of regulation is through the National Indian Gaming Commission ("NIGC"). The NIGC was created in 1988 when Congress enacted the IGRA. The role of the NIGC is to regulate Class II gaming operations in coordination with the tribal governments. Overall the NIGC's purpose is to shield Indian tribes from organized crime and other corrupting influences; and ensure that Indian tribes are the primary beneficiaries of gaming revenues. The NIGC is authorized to conduct investigations; undertake enforcement actions, including the assessment of fines and the issuance of closure orders; conduct background investigations; conduct audits; review and approve tribal gaming ordinances and management contracts; and issue such regulations as are necessary to meet its responsibilities under the IGRA.
In addition to these three distinct levels of regulation tribal government gaming operations are also subject to oversight by the Federal Government; the Department of Justice, the Bureau of Indian Affairs, the FBI, the IRS, the U.S. Attorneys, the U.S. Marshals, Attorneys General, the Secret Service, Treasury Department, and the Financial Crimes Network who monitors cash transactions for money laundering activities.
